Under this regulation, “industrial hemp” refers to the Cannabis sativa L. plant containing no more than 0.3% Delta-9 THC concentration on a dry weight basis. This Delta-9 THC threshold—not THCA or total THC—determines federal legality as documented in certified laboratory analyses.

Hemp flower, though part of the cannabis family, is distinct from marijuana and is federally legal to possess and sell in all 50 states.
