Our CBD products, including CBD flowers, are cultivated in strict compliance with the Agricultural Act of 2014 and the federal guidelines specified in 7 U.S.C. §5940, otherwise known as the 2014 Farm Bill. This act authorizes the growth, cultivation, and marketing of industrial hemp products via designated pilot programs.
Our commitment to providing legal, high-CBD industrial hemp within the United States is aligned with the protections afforded by these programs. According to the definition in 7 U.S.C. §5940, “industrial hemp” refers to the Cannabis sativa L. plant, in its entirety, irrespective of its growth stage, with a Delta-9 tetrahydrocannabinol (Delta-9 THC) concentration of no more than 0.3% on a dry weight basis. The Delta-9 THC level is the primary determinant of its legality, not THC-A or total THC as may be listed on industry-standard certificates of analysis.
Hemp flower, although it derives from the same family, is not marijuana, and it is perfectly legal to possess and sell. This legality spans all states, as guaranteed by the Full Faith and Credit Clause, Article VI, Section 1 of the Constitution, the Supremacy Clause, Article VI, Section 2 of the Constitution, and the Equal Protection Clause, Section 1 of the Fourteenth Amendment.
Furthermore, our Delta 8 and Delta 9 products are derived from compliant hemp extract sources in line with federal guidelines. As proud members of the Midwest Hemp Council, we are committed to staying abreast of the legal status of alternative cannabinoids at both the federal and state levels.
